Terms and Conditions
Contractual terms for use of the platform, billing, data handling, and subscriber obligations.
ACCEPTANCE BY ELECTRONIC ASSENT
By clicking 'Start Free Trial', 'Sign Up', 'Sign In', or otherwise accessing or using the My Accounts platform, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions, the Privacy Policy, and the AI Policy, each as amended from time to time.
If you are registering on behalf of a business, company, or other entity, you represent that you have authority to bind that entity and that these Terms are entered into by that entity.
If you do not agree, do not access or use the Platform.
1. Definitions
In these Terms, unless the context otherwise requires:
"AI Policy" means the My Accounts AI Policy published at my-accounts.com.au, as amended from time to time.
"Authorised Users" means individuals authorised by the Subscriber to access and use the Platform under the Subscriber's subscription. My Accounts subscriptions include unlimited users per company.
"Customer Data" means all data, content, and materials uploaded to, entered into, or generated within the Platform by the Subscriber or Authorised Users, including financial records, contact data, transaction records, and documents.
"Fees" means the subscription and usage-based fees payable for access to the Platform and any activated add-on modules, as set out in the current pricing schedule at my-accounts.com.au.
"Free Trial" means the 30-day free trial period available to new subscribers, as described in clause 4.
"Intellectual Property Rights" means all rights in patents, copyright, trade marks, designs, trade secrets, know-how, and all other intellectual and industrial property rights, whether registered or unregistered.
"Platform" means the My Accounts cloud-based Lead-to-Ledger operating system, including all modules, mobile applications, APIs, and related services made available by My Accounts.
"Privacy Policy" means the My Accounts Privacy Policy published at my-accounts.com.au, as amended from time to time.
"Subscriber" means the individual or business entity that creates an account and subscribes to the Platform. Where a business or company registers, the Subscriber is that entity; where an individual registers in their own right, the Subscriber is that individual.
"Subscription Period" means each monthly billing cycle for which Fees are paid, commencing after the Free Trial period and renewing automatically in accordance with clause 5.
"My Accounts", "we", "us", or "our" means the operator of the My Accounts platform, including its successors and assigns.
2. Grant of Licence
Subject to the Subscriber's compliance with these Terms and timely payment of all Fees, My Accounts grants to the Subscriber a non-exclusive, non-transferable, revocable licence to access and use the Platform during the Subscription Period solely for the Subscriber's internal business operations.
The licence extends to Authorised Users. The Subscriber remains responsible for all acts and omissions of its Authorised Users.
The Subscriber must not: (a) sublicence, resell, or transfer access to the Platform; (b) copy, modify, reverse engineer, or decompile any part of the Platform; (c) use the Platform to build a competing product; (d) remove proprietary notices; or (e) use the Platform in breach of applicable law.
All rights not expressly granted are reserved to My Accounts.
3. Accounts, Access and Multi-Company
The Subscriber is responsible for maintaining the security of all account credentials and for all activity under its account.
The Subscriber must promptly notify My Accounts of any suspected unauthorised access or security breach.
The Platform supports multiple company entities under one subscription. Each company is separately scoped, with independent data isolation, role-based access, and module activation. Fees apply per company per month.
The Subscriber's subscription administrator is responsible for managing company access, user roles, module activation, and billing for each company on the subscription.
4. Free Trial
New subscribers receive a 30-day free trial with access to the Platform. No credit card is required to start a free trial.
At the end of the free trial, continued access to the Platform requires activation of a paid subscription. If no subscription is activated, access will cease and data may be retained for a limited period before deletion in accordance with clause 8.
My Accounts reserves the right to modify or discontinue the free trial offer at any time without prior notice.
5. Subscription, Fees and Billing
Fees are billed per company per month in advance at the rates set out in the current pricing schedule at my-accounts.com.au. Base plans are: Ledger Only ($7/company/month ex GST) and Core ($30/company/month ex GST). Add-on module fees are as published.
Certain add-ons include usage-based components in addition to the monthly access fee, including: Soft Phone ($0.10/min usage); FullEnrich CRM Data ($2 per record). Usage charges are billed at the end of each billing cycle.
All Fees are quoted in Australian dollars, exclusive of GST. My Accounts will issue tax invoices for GST purposes.
Fees are processed via our payment processor. By subscribing, the Subscriber authorises My Accounts to charge the nominated payment method for all Fees as they fall due.
Fees are non-refundable except as required by the Australian Consumer Law or as otherwise expressly stated in these Terms. My Accounts does not provide pro-rata refunds for unused portions of a Subscription Period upon cancellation.
If a payment fails, My Accounts may suspend access until outstanding amounts are paid, with reasonable notice before suspension.
6. Auto-Renewal and Price Changes
Subscriptions renew automatically at the end of each Subscription Period at the then-current Fees unless cancelled before the renewal date in accordance with clause 7.
My Accounts will provide at least 14 days' written notice (by email to the Subscriber's registered billing address) of any increase in base Fees before that increase takes effect. Continued use after the notified effective date constitutes acceptance of the new Fees.
The Subscriber may cancel before the renewal date to avoid being charged at the new rate. No refund of Fees already paid is provided on cancellation.
7. Cancellation and Termination
The Subscriber may cancel a company subscription at any time through the billing settings within the Platform. Cancellation takes effect at the end of the then-current Subscription Period.
My Accounts may terminate these Terms immediately by written notice if: (a) the Subscriber materially breaches these Terms and fails to remedy the breach within 14 days of notice; (b) the Subscriber becomes insolvent or ceases to carry on business; or (c) continued provision of the Platform poses legal or regulatory risk.
8. Data on Termination or Cancellation
Following cancellation or termination of a subscription:
The Subscriber will have access to the Platform to export Customer Data for a grace period of 30 days from the effective date of termination or cancellation.
My Accounts will automatically delete Customer Data after the 30-day export window has expired, subject to any legal obligation to retain data for a longer period.
After deletion, Customer Data cannot be recovered. The Subscriber is solely responsible for exporting and retaining any data it requires before the export window closes.
My Accounts may retain anonymised or aggregated usage data that does not identify the Subscriber for its own operational and analytical purposes.
9. Customer Data and Ownership
As between the parties, the Subscriber retains all ownership of and Intellectual Property Rights in Customer Data.
The Subscriber grants My Accounts a limited licence to store, process, and use Customer Data solely to provide the Platform and perform obligations under these Terms.
My Accounts handles Customer Data in accordance with the Privacy Policy. The Subscriber warrants that it has all necessary rights, consents, and authorisations to upload Customer Data to the Platform.
The Subscriber is solely responsible for the accuracy, legality, and appropriateness of all Customer Data it uploads or generates.
10. AI Features
My Accounts uses AI-assisted features in limited parts of the Platform, specifically within the Lead & CRM Intelligence add-on. These features are powered by Google Gemini. The full scope of AI use, data handling, and limitations are set out in the AI Policy, which is incorporated into these Terms by reference.
By activating or using AI-assisted features, the Subscriber acknowledges it has read and agrees to the AI Policy.
My Accounts does not guarantee the accuracy, completeness, or fitness for purpose of any AI-generated output. The Subscriber uses AI features at its own risk.
11. Privacy
My Accounts collects, uses, and discloses personal information in accordance with the Privacy Policy, incorporated into these Terms by reference.
The Subscriber is responsible for its own compliance with applicable privacy laws, including the Privacy Act 1988 (Cth), in respect of personal information it collects from its customers, suppliers, and employees and uploads to the Platform.
12. Intellectual Property
My Accounts and its licensors own all Intellectual Property Rights in the Platform, including all software, code, interfaces, trade marks, and content. Nothing in these Terms transfers any Platform Intellectual Property Rights to the Subscriber.
If the Subscriber provides feedback or suggestions, My Accounts may use that feedback without restriction or obligation.
13. Third-Party Integrations and Services
The Platform integrates with or enables connections to third-party services, including bank feed providers, payment processors, FullEnrich, Soft Phone infrastructure, and Google Gemini. My Accounts does not control and is not responsible for third-party services, their availability, data handling, or accuracy of data returned.
The Subscriber's use of third-party integrations is at its own risk and subject to the terms of those third parties.
14. Warranties and Disclaimers
My Accounts warrants that it will provide the Platform with reasonable care and skill.
To the maximum extent permitted by law, the Platform is provided on an 'as is' and 'as available' basis. My Accounts does not warrant that the Platform will be uninterrupted, error-free, or that data will not be lost or corrupted.
Nothing in these Terms excludes, restricts, or modifies any right, remedy, guarantee, or warranty implied or imposed by the Australian Consumer Law that cannot lawfully be excluded. Where the Australian Consumer Law applies, My Accounts' liability is limited, to the greatest extent permitted by law, to resupply of the relevant service or payment of the cost of resupply.
15. Limitation of Liability
To the maximum extent permitted by law, My Accounts' total aggregate liability to the Subscriber under or in connection with these Terms is limited to the total Fees paid by the Subscriber in the three months immediately preceding the event giving rise to the claim.
To the maximum extent permitted by law, My Accounts excludes all liability for: (a) loss of profits, revenue, or business opportunity; (b) loss of data or corruption of data; (c) loss of goodwill; (d) consequential, indirect, special, or punitive loss; whether or not advised of the possibility of such loss.
This clause does not limit liability for fraud or any liability that cannot lawfully be excluded.
16. Indemnity
The Subscriber agrees to indemnify and hold harmless My Accounts and its directors, officers, employees, agents, successors, and assigns from and against any claim, liability, loss, damage, cost, or expense (including reasonable legal costs) arising from: (a) the Subscriber's or any Authorised User's use of the Platform in breach of these Terms; (b) Customer Data that infringes a third party's rights or violates applicable law; or (c) the Subscriber's breach of applicable laws in connection with use of the Platform.
17. Audit Trail and Compliance
The Platform maintains a full audit trail of transactions, changes, and postings. The Subscriber acknowledges that the audit trail is a feature of the Platform and that My Accounts does not provide accounting, tax, or financial advice in connection with the Platform or its outputs.
The Subscriber is solely responsible for the accuracy of its financial records, compliance with applicable accounting standards, and its tax and regulatory obligations. My Accounts is a technology platform provider only.
18. General
Governing Law
These Terms are governed by the laws of Queensland, Australia. The parties submit to the exclusive jurisdiction of the courts of Queensland and the Federal Court of Australia.
Entire Agreement
These Terms, together with the Privacy Policy and AI Policy, constitute the entire agreement between the parties with respect to the Platform and supersede all prior representations, negotiations, and understandings.
Severability
If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions continue in full force.
Waiver
Failure to exercise a right under these Terms does not constitute a waiver of that right.
Assignment
The Subscriber may not assign rights or obligations under these Terms without My Accounts' prior written consent. My Accounts may assign these Terms to a successor entity in connection with a merger, acquisition, or asset sale.
Relationship of Parties
The parties are independent contractors. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship.
Notices
Notices must be in writing and sent by email. Notices to My Accounts must be sent via the contact options at my-accounts.com.au. Notices to the Subscriber will be sent to the email address registered to the billing account.
Predecessor and Successor Entities
These Terms bind and benefit all predecessor entities that operated the Platform or any predecessor service, all successor entities, and any entity to which the Platform business is transferred or assigned.
